Terms of service
Terms of Service
Last updated: 6 October 2026
These Terms of Service govern your use of the Archivum Custodio online store and the process for purchasing products from us. By using our store or submitting an order, you agree that these Terms apply to your use of the store and, where a sales contract is formed, to that transaction.
These Terms operate together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
About Archivum Custodio
Archivum Custodio is an Australian online retailer of trading card game accessories and related products.
For customer support, order questions or policy enquiries, contact us at archivumcustodio@gmail.com.
Using our store
You may use our store for lawful personal or business purchasing purposes. You must not misuse the website, attempt to interfere with its operation, access systems without authorisation, introduce malicious code, use the store for fraudulent activity, or use our content in a way that infringes the rights of Archivum Custodio or another person.
If you place an order on behalf of another person or organisation, you confirm that you have authority to do so.
Products and product information
We aim to describe and display products accurately and to keep customer-facing information current. Product images, colours and presentation can vary slightly depending on screens, photography, manufacturing batches or other reasonable factors, but this does not permit a product to be materially different from its description.
If a product is faulty, damaged, incorrect, unsafe, materially different from its description or otherwise does not meet applicable consumer guarantees, your rights are governed by the Australian Consumer Law and our Returns & Refunds Policy.
We do not adopt supplier or marketplace claims as Archivum Custodio promises unless those claims are expressly included in our customer-facing product information or policy.
Availability and dropshipping fulfilment
Archivum Custodio uses a dropshipping fulfilment model for some or all products. This means we do not necessarily hold each item ourselves, and an order may be fulfilled by a third-party supplier or fulfilment provider on our behalf, including from outside Australia.
Stock and supplier availability can change. If an item becomes unavailable after you order, or we become aware that we cannot supply it within a promised or reasonable time, we will contact you and provide an appropriate solution. This may include a revised arrangement, cancellation, refund, or a substitute product if you agree to the substitution.
We will not substitute a different product without your agreement.
Archivum Custodio remains your retailer and point of contact even where a third party fulfils the order.
Prices and charges
The price payable is the price shown for the product at checkout.
If we discover a genuine pricing or technical error before accepting your order, we may contact you to confirm whether you want to proceed at the corrected price or cancel the affected item or order. We will not charge you a higher price without your agreement.
If an error is discovered after a sales contract has already formed, we will handle the matter in accordance with applicable law.
Any shipping charge payable to Archivum Custodio will be shown before you complete checkout. Other taxes, duties or charges will be handled and disclosed as required by applicable law and the checkout arrangement for the relevant destination.
We will not add an undisclosed mandatory charge after you have completed checkout, except where a charge is imposed directly by a government, customs authority, carrier or other third party in circumstances where applicable law permits and the relevant international shipping terms have been disclosed.
Payment
The payment methods available to you are those displayed at checkout. Payment processing may be provided by Shopify, PayPal, card networks or other payment service providers.
Your use of a payment method may also be subject to the payment provider's own terms. Those third-party terms do not remove any obligation Archivum Custodio owes you as the retailer.
Orders and contract formation
When you place an order, you are responsible for checking the products, variants, quantities, delivery address and contact details before submitting the order.
An automated order confirmation only acknowledges that we have received your order. It does not, by itself, mean that Archivum Custodio has accepted your order or that a sales contract has been formed.
Unless Archivum Custodio expressly accepts your order earlier, the sales contract for the relevant accepted item or items is formed when we send you confirmation that those item or items have been dispatched.
Before acceptance, availability, fraud checks, payment verification and fulfilment requirements may still need to be completed.
We may decline or cancel an order on reasonable grounds, including genuine stock unavailability, a material pricing or listing error, suspected fraud, payment failure, legal restrictions or inability to deliver to the requested destination.
If we cancel an order after receiving payment, we will return the amount we are required to refund as soon as reasonably practicable.
We will not cancel an order merely to avoid our obligations under the Australian Consumer Law or because a customer seeks to exercise a lawful consumer right.
Order changes and cancellations
Archivum Custodio does not provide a general right to cancel an order simply because you have changed your mind.
If you need to request an order change, address change or cancellation, contact archivumcustodio@gmail.com as soon as possible.
Where the order has not yet been processed or dispatched and it is operationally possible to do so, Archivum Custodio may agree to the requested change or cancellation.
We cannot guarantee that a request can be intercepted before processing or dispatch.
If we agree to cancel an order before dispatch, any amount requiring refund will be refunded as soon as reasonably practicable.
This does not limit any right you may have where we cannot supply the order, have supplied the wrong product, materially delay supply, or where the product or service otherwise fails to meet applicable consumer guarantees.
Shipping and delivery
At launch, Archivum Custodio ships to Australian delivery addresses only. International destinations may be enabled in the future where shown as available before or at checkout.
Delivery timing varies by product, fulfilment location, supplier, carrier and destination. Delivery estimates are estimates unless expressly stated to be guaranteed.
Our Shipping Policy forms part of these Terms and contains further information about fulfilment, delivery estimates, tracking, delays, lost parcels, address issues, split shipments and future international shipping.
Returns, refunds and remedies
Archivum Custodio does not offer a general change-of-mind return or exchange policy unless we expressly agree to a goodwill outcome in a particular case.
This does not affect your rights under the Australian Consumer Law. Consumer guarantees may entitle you to a repair, replacement, refund, compensation or another remedy depending on the circumstances.
Please contact Archivum Custodio before returning an item so that we can provide appropriate return, collection or other instructions for your particular case. The correct return destination can vary.
Our Returns & Refunds Policy forms part of these Terms and explains our customer-facing returns and remedy process in more detail.
Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify those guarantees, or any other right or remedy that cannot lawfully be excluded.
Where there is an inconsistency between these Terms and a non-excludable legal right, the legal right prevails to the extent of the inconsistency.
Site content and intellectual property
Unless otherwise stated, the Archivum Custodio name, store content, written material, branding, graphics and other original site material are owned by or licensed to Archivum Custodio.
You may view and use the store for normal purchasing and personal reference. You must not reproduce, republish, sell, exploit or materially modify our original site content for commercial purposes without permission, except where the law allows it.
Third-party content, links and services
Our store may use or link to third-party services, including payment providers, carriers, applications, social platforms or external websites.
A third party's service is subject to that party's own terms and practices. We are not responsible for controlling an independent third party's website or service, but this does not remove any responsibility Archivum Custodio has for your order or any liability that cannot be excluded by law.
Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy and applicable privacy law.
By using third-party payment, shipping or platform services through the store, information may also be processed by those providers in accordance with their applicable privacy terms.
Reviews, messages and customer content
If we make a review, messaging, image-upload or similar customer-content feature available and you submit content through it, you must have the right to provide that content and must not submit unlawful, misleading, abusive, defamatory, infringing or malicious material.
Where you provide content specifically for publication or use in connection with a review, enquiry or support matter, you permit us to use that content for the purpose for which it was provided, subject to applicable privacy law and any permissions required by law.
We are not required to publish customer-submitted content and may remove content where reasonably necessary for legal, safety, moderation or platform-compliance reasons.
Website availability and changes
We may maintain, update, change or temporarily suspend parts of the website where reasonably necessary for security, maintenance, operational or business reasons.
A website change does not remove or reduce obligations that already apply to an order you placed before the change.
We may update product ranges, prices and future offerings. Any changes are subject to applicable law and do not authorise misleading conduct or retrospective removal of customer rights.
Errors and corrections
We may correct genuine typographical, technical or administrative errors in website content, product information, pricing or availability.
If an error materially affects an order you have already placed, we will contact you and handle the matter fairly and in accordance with applicable law.
We will not rely on this clause to avoid a consumer guarantee or other non-excludable obligation.
Liability and non-excludable rights
To the maximum extent permitted by law, each party remains responsible for loss or damage to the extent that the law makes that party responsible.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from applicable consumer guarantees.
We do not promise that the website will be continuously available or completely free from technical interruption, but any interruption does not affect rights or obligations relating to completed purchases except to the extent the law permits.
Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, store functionality, policies or legal obligations.
Updated Terms apply prospectively from the date they are published unless the law permits otherwise.
We will not use a later version of these Terms to remove rights that already apply to an earlier completed transaction.
Severability
If a provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to operate where legally possible.
Governing law
These Terms are governed by the laws in force in Victoria, Australia, together with applicable Commonwealth laws.
Subject to any non-excludable rights about where a dispute may be heard, the parties may bring proceedings in courts or tribunals that have jurisdiction in Victoria or any other court or tribunal that applicable law permits to hear the matter.
